SUBMITTING A CONSUMER COMPLAINT
In accordance with Art. 6 item 3 of the Law on Provision of Services in Tourism (“Narodne novine” No. 130/17), the company informs consumers of their right to report dissatisfaction with the service provided, in writing by e-mail to hello@noselfie.co, whereby the company will, without delay, acknowledge the receipt of the complaint in writing.
Consumers can also send their objections by mail to NoSelfie travel agency, Kutnjački put 6, 10000 Zagreb. The company commits to respond in writing within 15 days of receipt of the written complaint. The complainant is obliged to indicate the first and last name and address for delivery of the reply.
TERMS AND CONDITIONS OF SALE
These Terms and Conditions define the ordering procedure, the payment process and the application of products and services offered through the website. The website may be used for private purposes, free of charge, in accordance with the Terms and Conditions defined herein. NoSelfie Travel Agency is the Provider and the person filling out the electronic order or e-mail inquiry and sending it to the provider via website and executing payment by credit card/debit card or bank transfer is the Customer. The commodity that is the object of the sale is one of the services offered on the website (transfer, excursion, etc.).
ORDER PROCESS
The Customer orders the product or products by way of electronic order form or e-mail. Every person ordering at least one product, providing the requested information and sending the order via webpage or e-mail is considered a Customer.
Prices displayed on the website are of informative purpose.
All prices are expressed in EURO and translated into the Croatian national currency, Croatian Kuna (Kn – HRK) according to the Croatian National Bank medium rate valid on the day of the transaction.
Final price of the package depends of services selected by the Client.
The ordering process is conducted in the following manner:
- The Customer selects the preferred itinerary suggestion on the website and sends e-mail inquiry or online order through website.
- The Customer fills out the form for the selected service or sends e-mail, entering the information regarding the date and time of service start, number of persons, possibly first and last names of these persons;
- After receipt of the e-mail or online order form, we process the inquiry and send reply to the Customer about the availability of the service, we agree on possible changes and services of clients interest (duration, type of the service). Before booking we provide the Customer with the final overview of all the information agreed before the final order confirmation;
- The Customer confirms the order by sending bank transfer or by paying on the spot, after the tour;
- Upon the finalisation of the ordering process by bank transfer, the Customer is provided with the voucher that serves as confirmation of the purchase and the payment. The voucher contains the following information, which clearly define the ordered service and the clients: voucher number, service ordered, date of service use (departure date), possible time of service use (departure time), possible date and time of service expiration, price of the service, number of customers, possibly first and last names of customers, possible departure location. The cancellation of the ordered service is regulated by the General Terms and Conditions.
PAYMENT
Ordered products or services are paid by bank transfer and on the spot - by cash or by by means of one of the following credit and/or debit cards: MasterCard®, Maestro® or Visa®, American Express®, Diners®. NoSelfie Travel Agency charges the Customer’s card upon the executed transaction.
SERVICE APPLICATION, USE
The services contained in the order and stated on the voucher may be realised in the following manner:
- the provided voucher serves as reservation and confirmation of the purchase, i.e. a ticket for the selected transfer, excursion, tour, cruise. The voucher may be used only once;
- in the event that the voucher is lost, it shall be reissued at the request of the Customer, in accordance with the General Terms and Conditions. For this purpose, the Customer shall contact NoSelfie Travel Agency with the request to reissue the voucher.
CONVERSION STATEMENT
The credit card is charged in Croatian kuna (Kn). The amount of Croatian Kuna that the credit card is charged with is obtained by conversion of EURO into Croatian Kuna according to the exchange rate determined for price lists (medium rate of the Croatian National Bank). The amount that is charged on the Customer’s credit card in Croatian Kuna shall be translated into the client’s national currency by the card company applying the valid foreign exchange list of the client’s county. Thus, minor deviations from the EURO prices stated on our website are possible.
STATEMENT OF PERSONAL DATA PROTECTION
NoSelfie Travel Agency undertakes to protect the personal data of the Customers by collecting only the basic information about the Customers/Clients, which are necessary to fulfil our obligations; it informs the Customers about the manner in which the collected data is used, regularly provides the Customers with the option of choosing the use of their data, including the possibility to choose whether they wish their name to be removed from the list used for marketing campaigns or not. All Customer information is strictly preserved and is available only to those employees who require them to perform their jobs. All employees and business partners of NoSelfie Travel Agency are responsible for observing the principle of privacy protection.
GENERAL TERMS AND CONDITIONS
Introduction
These Terms and Conditions of booking and purchase of one-day tours (hereinafter referred to as: Terms and Conditions) are an integral part of the Contract, i.e. voucher concluded by and between NoSelfie Travel Agency and the Customer / Client (hereinafter referred to as: the Customer) contracting the tourist package.
Booking and Contracting
The Customer may book the trip organised by NoSelfie Travel Agency, by e-mail, online order form, by telephone, or other means of remote communication, or with other authorised agents.
By sending bank transfer or paying on the spot where the tour takes place, the Customer fully accepts these Terms and Conditions upon having studied them carefully.
Price and Package Contents
As a rule, (unless stipulated otherwise in the program of a tour) the tour price shall include:
- agreed selection of activities/day tours/city guides
The package price does not include (unless stipulated otherwise):
- transport services,
- catering services
- costs of obtaining and issuing visas
- travel insurance
Copyright’s notice (scavanger hunt)
It is strictly forbidden to copy the elements of the game itself and the game scenarios. Scenarios and the course of the game as well as all the technical elements represent a complete piece of work.
Rules of game (scavanger hunt)
Customers are obliged to sign the consent before the start of the game with which they are bound not to violate the ban on revealing the secrets.
Customers are liable for damage to the specially marked equipment supplied by the seller.
Customers are obliged to act according to instructions provided by the seller before, during or after the game is over.
If during a game a third person or a higher force disables the game, time stops. The game will be continued by a customer's desire as soon as the cause of the interruption ceases. Otherwise, the amount paid for the service will be returned.
Buyer can at any time before the time finish or leave the game. In that case, the amount paid for the service will not be returned.
Customer is obliged to consistently watch over her property and health and avoid sources of danger, to give up or to refrain from proceedings that may endanger the safety, health and property of the cutomer or other participants.
Discounts for Children and Other Benefits
Please pay attention to discounts for children and other benefits which are specified in the package description.
Insurance from consequences of accident and illness, insurance from risk of damage and voluntary health insurance of persons during travelling and staying abroad
Tour prices do not include the insurance from the risk of accident and illness while travelling, nor do they include the insurance from the risk of damage or voluntary health insurance. By signing the tour Contract, with these Terms and Conditions as its integral part, it is understood that additional insurances have been offered and recommended to Customers. We recommend that you purchase travel insurance, prior to the tour.
Cancellation by NoSelfie Travel Agency
- Shared day group tours tours with set departure date an time
If the sufficient number of passengers has not booked the program, NoSelfie Travel Agency reserves the right to cancel the travel 12h prior to the day tour.
The minimum number of passengers required for a specific travel shall be specially marked on each program. If the tour is cancelled by NoSelfie Travel Agency, the Customer shall be entitled to the full refund of the amount paid, not including the compensation of damages.
Service cancelation due to Risk Assessment
NoSelfie Travel Agency holds the right to exclude from the tour any person, if they find that the person is not capable for participating safely in the tour, or if they evaluate that the person might harm the safety of the tour or other members on the tour. In such case no refund or compensation of damage will be made to excluded individual(s).
Travel Documents
Customers must have valid personal travel documents. Invalid documents leading to the cancellation of the travel shall not result in any harmful consequences for NoSelfie Travel Agency, and, if NoSelfie Travel Agency should suffer additional damages due to such an omission by a Customer, the Customer must compensate the damages suffered. If a travel document should be lost or stolen during travel, the costs of issuing new documents shall be borne by the Customer. NoSelfie Travel Agency’s guide shall assist the Customer in such a situation, taking care of the normal course of the program thereby.
Foreign Exchange and Customs Regulations
Customers must comply with all foreign exchange and customs regulations, laws and other by-laws of the Republic of Croatia and other countries through which they travel and where they stay.
If the tour cannot be continued because a Customer has violated the regulations, all incurred costs shall be borne solely by the person having violated the regulations.
Health Regulations
Travel to some countries is conditioned by mandatory vaccination against specific diseases. When travelling to such countries, the Customer must hold certificates and documents of vaccinations.
Baggage
In case of transport, a Customer may have 2 pieces of personal baggage. Customers must take care of their belongings brought on the vehicle and are obliged to bring them along whenever leaving the bus. Otherwise, Customers shall be responsible for theft, loss or damage of objects left unattended in the bus.
Complaints
Complaints are submitted in a written form.
We emphasise that it is in the interest of the Traveler to make sure that every complaint is enclosed in writing and the service provider will endeavour to provide the agreed service, i.e. correct the mistakes.
If no improvement is made even after the complaint, the Customer should ask for a certificate from which it is evident that the service was not provided, i.e. that it was not provided in the stipulated way. The Customer must enclose the certificate to their written complaint. The Customer is to make a written complaint no later than 7 days after the travel has ended. If the Customer should make a written complaint after the expiry of that term, NoSelfie Travel Agency is not obliged to take such a complaint into consideration. For resolving the complaints regarding services abroad, one must comply with the rule of reporting the complaint with the issue of certificate on the spot, and the deadline for submitting the complaint.
The organiser must make a written decision regarding the complaint within 14 days of receiving the complaint, and it may postpone the term for making the decision about the complaint by another 14 days on account information gathering.
The organiser shall resolve only those complaints which could not have been eliminated at the Customer’s destination. While the resolution of the complaint is in process, but no longer than 14, i.e. 28 days after lodging the complaint, the Customer waives the right to mediation of any other person, the arbitration by UHPA or another institution, and undertakes not to provide media with the information. In this time period, the Customer also waives the right to sue. The maximum amount of compensation per complaint may reach the amount of the advertised part of services, but it may not include the services already used, or the entire package amount. The Customer and NoSelfie Travel Agency shall attempt to resolve disputes amicably, and, on the contrary, they stipulate the competence of the court in Zagreb. The competent law shall be the Croatian law.
NoSelfie Travel Agency Obligations
NoSelfie Travel Agency undertakes to care about provision of services and the selection of service providers in accordance with the best business practices, and to take care of the Customers' rights and interests in compliance with the best tourism practices.
NoSelfie Travel Agency undertakes to provide the Customer with all the contracted services for a particular package, and to provide answers in case of possible failure to perform services or a part of services. NoSelfie Travel Agency shall fulfil all the obligations stated in its programs fully and as described, except in the event of Force Majeure or changed circumstances. In such cases, NoSelfie Travel Agency shall offer a substitute solution if possible. NoSelfie Travel Agency is not obliged to provide services beyond these Terms and Conditions. NoSelfie Travel Agency is not responsible for possible print errors.
If, after the start of the tour, significant elements of the tour cannot be provided as agreed, suitable alternative arrangements will have to be offered to the traveller at no extra cost. Travellers may terminate the contract without paying any termination fee, where services are not performed in accordance with the contract and this substantially affects the performance of the package and the organiser fails to remedy the problem.
Travellers are also entitled to a price reduction and/or compensation for damages where the travel services are not performed or are improperly performed.
Customer’s Obligations
The Customer undertakes to personally meet the conditions anticipated by the regulations of the Republic of Croatia and the country through which or to which they travel, and to observe the house rules in hotel and other facilities, to cooperate with the representative of the organiser and with service providers. The Customer is personally responsible for any damages caused, particularly for the damages that are the result of failure to observe the contract and these General Terms and Conditions. The Customer shall cover the incurred damages immediately at the place stipulated by the physical or legal entity who suffered the damages.
Personal Data Protection
The Customer provides personal data voluntarily. Personal data of the Customer are necessary in the process of realisation of the requested service. These shall also be used for further mutual communication.
NoSelfie Travel Agency undertakes not to export the Customer’s personal data abroad, or provide any third persons with such information, except for the purposes of realisation of the requested service.
The exception to providing third persons with Customer’s personal data regards the contracting of insurance for the risk of cancellation, insurance from consequences of accident and illness, insurance from risk of damage and loss of baggage and voluntary health insurance of persons during travelling and staying abroad. If the Customer should take out an insurance policy, personal data shall be forwarded to the insurance company.
Customer’s personal data shall be kept in a database, pursuant to the Decision of the Administration regarding the manner of collecting, processing and keeping personal data.
The Customers allow their personal data to be used for the purposes of NoSelfie Travel Agency marketing activities.
Final Provisions
These Terms and Conditions are an integral part of the Contract that the Customer enters into with NoSelfie Travel Agency, i.e. an authorised travel agency where they booked the trip organised by NoSelfie Travel Agency. Possible/anticipated deviations from these Terms and Conditions must be stated with the text of the tour program. By signing the contract, the Customer fully accepts the program and these Terms and Conditions. The issue of these Terms and Conditions makes all previous versions null and void.

Sukladno čl. 6. tč. 3. Zakona o pružanju usluga u turizmu („Narodne novine“, br. 130/17) obavještavamo potrošače da prigovor kojim iznose svoje nezadovoljstvo u odnosu na kupljeni proizvod ili pruženu uslugu mogu podnijeti u pisanom obliku, te će im bez odgađanja pisanim putem biti potvrđen primitak tog prigovora. Na Vaš prigovor odgovoriti ćemo u roku od 15 dana od dana primitka podnesenog prigovora, a prije toga bez odgađanja pisanim putem potvrditi primitak prigovora.
UVJETI PRODAJE
Ovim se uvjetima utvrđuje postupak naručivanja, plaćanja te preuzimanja proizvoda i usluga ponuđenih na web stranicama. Internet stranice mogu se koristiti za vašu privatnu upotrebu bez ikakvih naknada za korištenje, a prema sljedećim uvjetima i pravilima. Prodavatelj je NoSelfie Travel Agency, a kupac je posjetitelj ovih stranica koji popuni elektronsku narudžbu, pošalje je prodavatelju putem web stranica ili e-mailom, te izvrši plaćanje putem kreditne/debitne kartice ili bankovnim transferom. Roba, predmet prodaje, je jedna od usluga iz ponude na stranicama.
NARUČIVANJE
Kupac naručuje usluge putem e-maila i/ili elektronskog obrasca narudžbe. Kupcem se smatra svaka osoba koja elektronski naruči barem jednu uslugu, popuni tražene podatke i pošalje narudžbu putem web stranica ili e-mailom. Cijene su iskazane u EUR, preračunate u hrvatsku nacionalnu valutu, hrvatska kuna (Kn), prema srednjem tečaju Hrvatske narodne banke na dan transakcije.
Za realizaciju usluga koje Kupac naruči putem ovih web stranica, Kupac nema obavezu plaćanja nikakvih dodatnih troškova. Prije prihvaćanja ponude, Kupac će dobiti sve bitne informacije o dogovorenom izletu.
Proces naručivanja
- Kupac odabire prijedlog itinerara na web stranicama i šalje upit e-mailom ili putem online obrasca;
- Za odabranu uslugu, na obrascu za naručivanje ili u e-mailu unosi podatke o datumu i vremenu početka usluge, broju osoba, eventualno imenima i prezimenima osoba;
- Po primitku obrasca ili e-maila šaljemo povratnu informaciju klijentu sa potvrdom raspoloživosti usluge, dogovaramo eventualne izmjene (trajanje, vrsta usluga, tip smještaja) i kupcu još jednom šaljemo sve detaljne podatke o dogovorenom sadržaju usluge prije konačne potvrde narudžbe;
- Kupac potvrđuje narudžbu i uplaćuje potvrdu rezervacije bankovnim nalogom ili uslugu plaća nakon obavljene usluge, gotovinom ili karticom.
- Po završetku procesa naručivanja kupac dobiva vaučer koji služi kao potvrda kupovine i plaćanja. Vaučer sadrži sljedeće podatke koji nedvosmisleno definiraju naručenu uslugu i korisnike usluge: broj vaučera, naručena usluga, datum korištenja usluge (datum polaska), eventualno vrijeme korištenja usluge (vrijeme polaska), eventualno datum i vrijeme završetka usluge, cijena usluge, broj korisnika, eventualno imena i prezimena korisnika, eventualno mjesto polaska. Otkaz naručene usluge reguliran je općim uvjetima poslovanja.
PLAĆANJE
Naručeni proizvodi ili usluge plaćaju se jednom od kreditnih i/ili debitnih kartica ili nalogom banci. Plaćanje kreditnim i/ili debitnim karticama MasterCard®, Maestro® ili Visa®, American Express®, Diners® se vrši putem Pence Pay servisa. Plusculus d.o.o. tereti karticu kupca po uspješno izvršenoj transakciji. Po izvršenoj uplati, kupcu se račun o uplaćenom predujmu šalje e-mailom.
PREUZIMANJE, KORIŠTENJE USLUGE
Usluge sadržane u narudžbi i navedene na vaučeru mogu se realizirati na sljedeći način:
Dostavljeni vaučer služi kao rezervacija i potvrda kupnje odnosno ulaznica za odabrani transfer, izlet, turu, krstarenje. Kupac vaučer predaje zastupniku agencije po dolasku na ukrcajno mjesto za transfer, izlet, turu, krstarenje. Vaučer se može iskoristiti samo jedan put.
Ponovno izdavanje vaučera u slučaju eventualnog gubitka, vrši se sukladno općim uvjetima poslovanja na zahtjev kupca. U tom smislu kupac kontaktira NoSelfie Travel Agency sa zahtjevom za ponovno izdavanje vaučera.
IZJAVA O KONVERZIJI
Naplata po kreditnoj kartici vrši se u hrvatskim kunama (Kn). Iznos u hrvatskim kunama za koji će biti terećena vaša kreditna kartica dobiva se konverzijom EUR-a u Hrvatske kune prema tečaju utvrđenom za cjenike (srednji tečaj Hrvatske narodne banke). Iznos terećenja kreditne kartice u hrvatskim kunama vaš kartičar preračunava u vašu domicilnu valutu primjenom tečajne liste važeće u vašoj zemlji. Sukladno tome, moguća su minimalna odstupanja od cijene u EUR-ima istaknute na našoj web stranici.
IZJAVA O ZAŠTITI OSOBNIH PODATKA
NoSelfie Travel Agency se obavezuje pružati zaštitu osobnih podataka kupaca, na način da prikuplja samo nužne, osnovne podatke o kupcima/korisnicima koji su nužni za ispunjenje naših obveza; informira kupce o načinu korištenja prikupljenih podataka, redovito daje kupcima mogućnost izbora o upotrebi njihovih podataka, uključujući mogućnost odluke žele li ili ne da se njihovo ime ukloni s lista koje se koriste za marketinške kampanje. Svi se podaci o korisnicima strogo čuvaju i dostupni su samo djelatnicima kojima su ti podaci nužni za obavljanje posla. Svi djelatnici NoSelfie Travel Agency i poslovni partneri odgovorni su za poštivanje načela zaštite privatnosti.
OPĆI UVJETI POSLOVANJA
Uvodna napomena
Ove Upute i uvjeti rezervacije i kupnje turističkih aranžmana (u daljnjem tekstu Upute i uvjeti) sastavni su dio Ugovora odnosno vaučera koji su sklopljeni između NoSelfie Travel Agency i putnika/ugovaratelja turističkog aranžmana (u daljnjem tekstu Putnik) koji se prijavljuje za turistički aranžman.
Prijave i ugovaranje
Putnik se za turu koju organizira NoSelfie Travel Agency može prijaviti online obrascom sa web stranica, e-mailom, telefonom ili drugim sredstvima komunikacije na daljinu, te kod drugih ovlaštenih agenata. Kupac potvrđuje narudžbu plaćanjem putem bankovnog naloga ili po izvršetku usluge, kod kupnje usluga putem sredstava komunikacije na daljinu. Putnik u cijelosti prihvaća ove Upute i uvjete koje je prethodno pažljivo proučio.
Cijena i sadržaj aranžmana
U cijenu aranžmana (ukoliko u programu putovanja nije drugačije navedeno) u pravilu je uključeno sljedeće:
- izbor dnevnih izleta/aktivnosti/stručnih vođenja – dogovorenih prije sklapanja Ugovora
U cijenu aranžmana nije uključeno sljedeće (osim ako nije drugačije naglašeno):
- usluge prijevoza,
- ugostiteljske usluge,
- mogući troškovi pribavljanja i izdavanja viza
- putno osiguranje
Autorska prava (scavanger hunt)
Strogo je zabranjeno kopiranje elemenata same igre i scenarija igre. Scenariji i tijek igre kao i svi tehnički elementi predstavljaju cjelovito autorsko djelo.
Pravila igre (scavanger hunt)
Zakupci su prije početka igre dužni potpisati suglasnost s kojom se obvezuju da neće kršiti zabranu otkrivanja tajne. Također i suglasnost za obradu osobnih podataka s kojom daje izjavu da je upoznat sa svojim pravima prema GDPR.
Kupci odgovaraju za štetu na posebno označenoj opremi koju im predaje prodavatelj.
Kupci su dužni postupati prema uputama koje im posreduje ponuditelj prije, tijekom ili nakon završene igre.
Ako tijekom igre treća osoba ili viša sila onemogući nastavak igre, vrijeme se zaustavlja. Igra se na želju kupca nastavlja čim prestane uzrok prekida. U suprotnom se kupcu vraća iznos plaćen za uslugu.
Kupac može u bilo koje vrijeme prije vremena završiti ili napustiti igru. U tom se slučaju iznos plaćen za uslugu ne vraća.
Kupac je dužan sam dosljedno čuvati svoju imovinu i zdravlje i izbjegavati izvore opasnosti, odustati ili se suzdržavati od postupaka koji mogu ugroziti sigurnost, zdravlje te imovinu naručitelja ili drugih sudionika.
Popusti za djecu i druge pogodnosti
Molimo da obratite pozornost na popuste za djecu, kao i na ostale pogodnosti koje su posebno prikazane u opisu dogovorenog aranžmana.
Osiguranje od posljedica nesretnog slučaja i bolesti i dragovoljno zdravstveno osiguranje osoba za vrijeme puta i boravka u inozemstvu
Cijene putovanja ne uključuju osiguranje od rizika nesretnog slučaja i bolesti na putovanju kao ni dragovoljno zdravstveno osiguranje.
Potpisivanjem ugovora o putovanju, čiji su sastavni dio i ove Upute i uvjeti, smatra se da su putnicima ponuđena i preporučena dodatna osiguranja navedena u prethodnom stavku.
U slučaju da Putnik zahtijeva navedena osiguranja, ona se mogu ugovoriti izravno kod jednoga od osiguravatelja. Preporučamo pozorno proučiti uvjete osiguranja prije ugovaranja polica osiguranja.
Otkaz putovanja od strane NoSelfie Travel Agency ili promjena programa
Dnevne ture s definiranim datumom polaska
Ukoliko se ne prijavi dovoljan broj putnika, NoSelfie Travel Agency zadržava pravo otkaza putovanja 12h prije polaska za dnevne izlete.
Najmanji broj putnika potreban za izvršenje pojedinog putovanja posebno je naznačen kod svakog programa/aranžmana. NoSelfie Travel Agency zadržava pravo potpune i djelomične promjene programa putovanja ukoliko prije početka putovanja nastupe izvanredne okolnosti koje nije bilo moguće predvidjeti ili izbjeći.
NoSelfie Travel Agency zadržava pravo promjene dana ili sata polaska zbog izmjena reda plovidbe ili vožnje ili nastupanja nepredviđenih okolnosti, kao i pravo izmjene pravca putovanja ukoliko se promjene uvjeti putovanja kao što su neki od sljedećih: promjena voznog reda, plovidbenog reda, sigurnosna situacija u zemlji, vremenske (ne)prilike i to bez isplate odštete.
Ukoliko NoSelfie Travel Agency otkaže putovanje, Putnik ima pravo na isplatu uplaćenog iznosa u cijelosti, ali ne i na naknadu štete.
Otkaz zbog procjene rizika
NoSelfie Travel Agency zadržava pravo odbiti pružiti uslugu putniku u slučaju da procjeni da bi njegovo sudjelovanje u aktivnosti imalo znatan utjecaj na povećanje rizika od nezgode.
U tome slučaju putnik nema pravo na povrat uplaćene naknade, kao na ni sniženje cijene zbog nesudjelovanja u ranije dogovorenoj aktivnosti.
Putnik u slučaju isključenja zbog procjene povišenog rizika sudjelovanja, nema pravo na odštetu.
Putne isprave
Putnici su obvezni posjedovati valjane osobne putne isprave. Nevaljane isprave, koje imaju za posljedicu odustajanje od putovanja, ne proizvode nikakve štetne posljedice za NoSelfie Travel Agency, a ukoliko bi zbog takvog propusta Putnika NoSelfie Travel Agency pretrpio dodatnu štetu, Putnik je dužan istu nadoknaditi. Ukoliko za vrijeme putovanja dođe do gubitka ili krađe putnih isprava, troškove izdavanja novih isprava snosi sam Putnik.
NoSelfie Travel Agency pratitelj će pomoći Putniku u slučaju gore navedene situacije, ali vodeći pritom računa o normalnom odvijanju programa.
Devizni i carinski propisi
Putnici su dužni pridržavati se deviznih i carinskih propisa, kao i zakona i podzakonskih propisa Republike Hrvatske i drugih zemalja kroz koje prolaze i u kojima borave.
U slučaju nemogućnosti nastavka putovanja radi kršenja propisa od strane Putnika, sve nastale troškove snosi sam Putnik koji je prekršio propise.
Zdravstveni propisi
Za putovanja u neke zemlje potrebno je obaviti obvezna cijepljenja Putnika protiv nekih bolesti. Prilikom putovanja u takve zemlje Putnik je obvezan posjedovati potvrde i dokumente o cijepljenju.
Prtljaga
Kod prijevoza osobnim vozilom/mini-busom/kombije/autobusom, Putnik može ponijeti 2 komada osobne prtljage. Putnik je dužan voditi brigu o svojim stvarima unesenima u kabinu vozila, te ih je prilikom svakog napuštanja istog dužan ponijeti sa sobom. U protivnom, Putnik sam snosi odgovornost za krađu, gubitak ili oštećenje stvari ostavljenih u kabini autobusa bez njegovog nadzora.
Reklamacije
Reklamacije se podnose u pisanom obliku.
Naglašavamo da je u interesu Putnika da svaki svoj prigovor svakako priloži pisanim putem, a pružatelj usluga će nastojati pružiti ugovorenu uslugu, odnosno ispraviti greške.
Ukoliko ni nakon prigovora ne bude poboljšanja, Putnik mora tražiti potvrdu iz koje se vidi da usluga nije pružena, odnosno da nije pružena na način kako je ugovoreno.
Potvrdu Putnik mora priložiti reklamaciji. Reklamaciju je Putnik je dužan uložiti u roku od 7 dana nakon završetka putovanja.
Ukoliko Putnik uloži reklamaciju u pisanom obliku nakon tog roka, NoSelfie Travel Agency takvu reklamaciju nije dužan uzeti u obzir.
Za rješavanje reklamacije na usluge u inozemstvu, obvezno treba poštivati pravilo prijave prigovora uz izdavanje potvrde na licu mjesta i rok za podnošenje reklamacije.
Organizator je dužan donijeti pismeno rješenje na ovaj prigovor u roku od 14 dana po primitku prigovora, a može odgoditi rok rješenja o pritužbi za dodatnih 14 dana zbog prikupljanja informacija.
Organizator će rješavati samo one pritužbe koje se nisu mogle otkloniti na Putnikovu odredištu. Dok postupak rješenja traje, a ukupno najviše 14, odnosno 28 dana od dana ulaganja prigovora, Putnik se neopozivo odriče posredovanje bilo koje druge osobe, arbitraže UHPA-e ili neke druge institucije, te se obvezuje da neće davati informacija u medije.
Isto tako, u ovom vremenu Putnik se odriče prava na tužbu. Najviši iznos nadoknade po prigovoru može doseći iznos reklamiranog dijela usluga, a ne može obuhvatiti već iskorištene usluge kao ni cjelokupni iznos aranžmana.
Putnik i NoSelfie Travel Agency će sporove nastojati razriješiti sporazumno, a u suprotnom ugovaraju nadležnost suda u Zagrebu. Mjerodavno pravo će biti hrvatsko pravo.
Obveze NoSelfie Travel Agency
NoSelfie Travel Agency je dužan brinuti se o izvršenju usluga, kao i o izboru davatelja usluga pažnjom dobrog gospodarstvenika te je dužan skrbiti o pravima i interesima Putnika sukladno dobrim običajima u turizmu.
NoSelfie Travel Agency je dužan Putniku pružiti sve ugovorene usluge za pojedini aranžman te dati odgovore zbog možebitnog neizvršenja usluga ili dijela usluga. NoSelfie Travel Agency će sve navedene obveze iz svojih programa izvesti u potpunosti i na opisani način, osim u slučaju "više" sile ili promijenjenih okolnosti. Ako bude moguće, NoSelfie Travel Agency će u takvim NoSelfie Travel Agency ponuditi zamjensko rješenje.
NoSelfie Travel Agency nije dužan pružati usluge van ovih Uputa i uvjeta. NoSelfie Travel Agency ne odgovara za eventualne pogreške u tisku.
Putnici imaju pravo na sniženje cijene i/ili naknadu štete ako usluge putovanja ne budu izvršene ili ako budu izvršene na nepravilan način.
Obveze putnika
Putnik je dužan brinuti se da osobno ispuni uvjete predviđene propisima Republike Hrvatske i zemlje kroz koju ili u koju putuje te je dužan pridržavati se kućnog reda u hotelskim i drugim objektima i surađivati s predstavnikom organizatora i davateljima usluga.
Putnik sam odgovara za štetu koju prouzroči, a posebno za štetu koja je nastala kao posljedica nepoštivanja ugovora i ovih Uputa i uvjeta.
Posljedice i troškove štete koju je prouzročio, Putnik će snositi odmah na mjestu određenom od fizičke ili pravne osobe kojoj je štetu nanio.
Zaštita osobnih podataka
Putnik osobne podatke daje dobrovoljno. Osobni podaci Putnika potrebni su u procesu realizacije tražene usluge. Isti će se koristiti i za daljnju međusobnu komunikaciju.
NoSelfie Travel Agency se obvezuje da neće osobne podatke Putnika iznijeti iz zemlje ili ih dati trećoj osobi, osim u svrhu realizacije tražene usluge..
Osobni podaci Putnika čuvat će se u bazi podataka, sukladno odluci Uprave o načinu prikupljanja, obrade i čuvanja osobnih podataka.
Putnik daje privolu da se njegovi osobni podaci mogu koristiti u svrhu marketinških akcija NoSelfie Travel Agency.
Završne odredbe
Ove Upute i uvjeti sastavni su dio Ugovora kojeg Putnik sklapa s NoSelfie Travel Agency, odnosno s ovlaštenom putničkom agencijom u kojoj se prijavio za putovanje u organizaciji NoSelfie Travel Agency. Moguća/predviđena odstupanja od ovih Uputa i uvjeta, moraju biti navedena uz tekst programa putovanja, ukoliko se radi o turoperatorima - inozemnim organizatorima putovanja. Potpisivanjem ugovora Putnik u cijelosti prihvaća program i ove Upute i uvjete. Izdavanjem ovih Uputa i uvjeta prestaju važiti sva ranije izdanja.
